Can Seattle factor union politics into land-use decisions?

Fuller Sears Architects rendering

This proposed mixed-use project in West Seattle is at the heart of an attempt by Seattle Mayor Mike McGinn to inject social-justice issues into a land-use decision. It's unclear whether that's legal.

Seattle Mayor Mike McGinn?s desire to hold up a large West Seattle real estate development because he doesn?t think Whole Foods pays employees enough raises the question: Is this legal?

No, according to longtime Seattle land-use attorney Elaine Spencer, who thinks McGinn?s move is unprecedented. She doesn?t see anything in the city?s policies that would let the mayor attempt this.

But the mayor says what he is doing is legal and that Seattle should expect more of the same if he wins a second term this fall.

Metaphorically speaking, McGinn threw a firecracker into the middle of the mayoral race when in a July 15 letter he recommended that the city not surrender an alley needed by the developers of the $100 million-plus apartment and retail project.

McGinn?s move just three weeks before the Aug. 6 primary is the latest example of local unions flexing their political muscles.

City of SeaTac voters on Nov. 5 will vote on a union-backed plan to raise the city?s minimum wage for some workers in and around Seattle-Tacoma International Airport to $15 an hour. With support from Working Washington, another group with ties to labor, fast-food employees have filed complaints with the Seattle Police Department alleging some restaurants did not pay them or made them work off the clock.

In a somewhat new twist, unions are pressing Seattle City Hall to use land-use regulations to block some big commercial real estate projects.

A union of hospitality workers is agitating against R.C. Hedreen Co.?s proposed $450 million downtown hotel project because the union thinks the hotel will bring too many low-paying jobs to Seattle.

Marc Stiles covers commercial real estate and government for the Puget Sound Business Journal.

Ex USF fraternity president sentenced to prison in child-sex case

A former university fraternity president was sentenced to 14 years in federal prison Wednesday for traveling to Maitland where he thought he was going to meet two girls for sex.

The FBI began investigating Dwipin Maliackal in December when he contacted an undercover agent on an "incest" chat room used by predators and pedophiles.

The agent was posing as the father of 10-year-old and 13-year-old girls.

Maliackal, 25, told the detective he was "into incest" and that he would "love" to make the 10-year-old his "girlfriend."

According to Maliackal's plea agreement, the former University of South Florida student said he wanted to get the 13-year-old pregnant.

Maliackal told the agent graphic things he wanted to do with the children and said he would travel to Orlando to meet them.

On Dec. 20, Maliackal drove from his home in the Tampa Bay area to a Maitland restaurant, where he arranged to meet the father and his two daughters.

After he was taken into custody, Maliackal admitted he planned to have sex with the supposed 13- and 10-year-old girls, the plea agreement said.

Agents also discovered Maliackal was a member of several online groups whose subject matter involves sex with children.

Maliackal pleaded guilty in April to one count of coercion or enticement of a minor. He faced a mandatory minimum of 10 years in prison.

During a sentencing hearing Wednesday in Orlando federal court, defense attorney Don West told the court Maliackal has been undergoing therapy while jailed in Seminole County.

Maliackal is remorseful, motivated to improve his mental health and a good candidate for rehabilitation, West said.

But Senior U.S. District Judge John Antoon II noted the vulgar conversations Maliackal had with the undercover agent and said Maliackal's actions were not a "momentary impulse."
