Law Profs - Center for Immigration Studies

A new paper by John Yoo (UC Berkeley School of Law) and Robert J. Delahunty (University of St. Thomas School of Law, Minnesota) raises many questions about President Obama's decision to grant legal status to nearly two million illegal aliens under deferred action and concludes that the president's act "threatens to vest the executive branch with broad domestic policy authority that the Constitution does not grant it." If taken to its logical conclusion, President Obama's lawless action has the power to undermine the entirety of immigration law, while expanding the presidential power in all domestic policy areas.

The professors explain:

For if a president can refuse to enforce a federal law against a class of 800,000 to 1.76 million, what discernible limits are there to prosecutorial discretion? Can a president decline to enforce federal laws barring that class from voting in federal elections? Can a president decline to enforce the deportation statute against all illegal immigrants because of a belief in an "open borders" policy? Can a president who wants tax cuts that a recalcitrant Congress will not enact decline to enforce the income tax laws? Can a president effectively repeal the environmental laws by refusing to sue polluters, or workplace and labor laws by refusing to fine violators?

The professors examine the executive branch's law enforcement powers and responsibilities, arguing that "the Constitution's Take Care Clause imposes on the president a duty to enforce all constitutionally valid acts of Congress in all situations and cases ? [and] that there is simply no general presidential non-enforcement power? [and that] the deliberate decision to leave a substantial area of statutory law unenforced or under-enforced is a serious breach of presidential duty." The professors argue that the White House "has provided no adequate excuse or justification for its non-enforcement decision."

While the professors acknowledge that Congress does share some of the blame for passing stringent immigration laws while failing to provide adequate funding, they explain:

A categorical refusal to enforce the removal statutes against any deportable alien ? effectively, the adoption of an "open borders" policy ? would also, we think, be unconstitutional. Even if enforcement resources were constrained, it would be an obvious refusal to perform the constitutional duty of faithful execution of the laws. Yet the logic of the June 15 non-enforcement decision points to the conclusion that the president may adopt exactly that policy if he wishes. If the president may constitutionally permit 15 percent of the nation's illegal immigrant population to remain in the United States without fear of removal, why may he not do the same for 50 percent of that population, or for all of it? True, as long as some funding was available to ICE for enforcement, the president could not claim that an appropriations shortfall justified the total cessation of deportation activities. Still, the president could deliberately allocate ICE's resources in such a way as to achieve essentially that result. But if the president can constitutionally implement an open borders policy on his own initiative and without authorization from Congress, what remains of the immigration law? The June 15 non-enforcement decision thus leads to absurdity. The failure of an agency to perform its ordinary enforcement duties may be so unreasonable that it may be considered unconstitutional, notwithstanding limitations on its resources.

The professors summarize their main points:

First, the common idea that the president has a positive constitutional "authority" to decide not to enforce the civil law is mistaken. The Take Care Clause, coupled with related constitutional provisions, establishes that the president has a duty to enforce the laws. The Constitution confers no express or implied power or authority not to enforce the laws. On the face of it, the Obama administration breached its constitutional duty by refusing to enforce the immigration law in (up to) 1.7 million cases.

Second, the administration cannot rely on a claim of presidential "prerogative" to justify a decision not to enforce the law. American constitutional practice, coupled with the Supreme Court's case law, does indeed suggest that there is a presidential prerogative. But if so, that prerogative is one granted by the Constitution; it is not extra-constitutional. And it is restricted to action for the sake of national security in times of war or sudden crisis. Presidential prerogative does not justify a refusal to enforce the immigration laws in ordinary, non-critical circumstances. Rather, the Constitution tries to solve the problem of reconciling the need for a strong executive with a republican form of government by giving the president broad, undefined powers in the international sphere but circumscribing his power closely in domestic matters.

Third, just as in common law, a range of defenses can be made to a breach of duty, so defenses can be offered for the administration's apparent breach of duty here. The main justifications or excuses that can be used to defend a breach of the duty of faithful execution fall into four main categories: that the "law" whose non-enforcement is at issue is unconstitutional; that enforcement in the particular circumstances would interfere materially with the exercise of another constitutional power of the president (such as those over foreign affairs and national security); that equity in individual cases warrants forbearance in enforcement; and most importantly here, that the enforcing agency lacks sufficient resources for complete enforcement and must therefore use its best judgment how to allocate the resources it has. The administration's non-enforcement decision with regard to the DREAMers does not, despite its claims to the contrary, appear to fall within any of these categories, including the last. It stands, thus far, as an unexcused breach of duty.

Fourth, the administration's decision is the almost inevitable outcome of what has been described as a "de facto" delegation system that Congress has established in the immigration area. The combination of a massive illegal immigrant population, extremely stringent laws regarding deportability, and inadequate resourcing for enforcement, it can be argued, gives the president virtually unfettered control to decide who remains in the country and who is removed. If this understanding of our immigration law system is correct, then that system poses a threat to the traditional conception of the rule of law and its attempt to control arbitrary executive action. It invites a president to create operative, functional "law" covering hundreds of thousands of cases that overtly contravenes statutory law.

The professors note that while the president has broad powers over foreign affairs, his authority over domestic matters is much more narrow. They conclude:

The conception of executive power we have defended is fully consistent with the attribution to the president of broad constitutional powers over foreign affairs, national security, and military policy. The Framers intended to give Congress the dominant role in regulating domestic matters, while giving the presidency, with its distinctive institutional qualities of energy, secrecy, speed, and unity of purpose, the primary responsibility for foreign affairs. Although immigration straddles domestic and foreign policy, Congress, not the president, has the controlling authority in that area.

The report includes an interesting historical overview that ultimately raises many questions about President Obama's end-run around the legislative process.

One in eight of world population going hungry: U.N

ROME (Reuters) - One out of every eight people in the world is chronically undernourished, the United Nations' food agencies said on Tuesday, and aid groups warned that rising food prices could reverse gains in the fight against hunger.

In a report on food insecurity, the UN agencies said 868 million people were hungry in 2010-2012, or about 12.5 percent of the world's population, down more sharply than previously estimated from about 1 billion, or 18.6 percent in 1990-92.

The new figures, based on a revised calculation method and more up-to-date data, are lower than the last estimates for recent years that pegged the number of hungry people at 925 million in 2010 and 1.02 billion in 2009.

"That is better news than we have had in the past, but it still means that one person in every eight goes hungry. That is unacceptable, especially when we live in a world of plenty," said Jose Graziano da Silva, director general of the Food and Agriculture Organisation (FAO).

"Most of the progress in hunger reduction was made until 2006, as food price levels continued to decline. With the rise in food prices and the economic crisis that followed, there have been many fewer advances," he warned.

Food prices have risen over the past few months, fuelled by drought in the United States, Russia and other major grain exporters, and FAO expects prices to remain close to levels reached during the 2008 food crisis.

But Graziano da Silva said the world can still achieve the Millennium Development Goal to halve the prevalence of undernourishment in the developing world by 2015.

The goal is one of a series of targets adopted by world leaders at the United Nations in 2000 to slash poverty, hunger and disease in poor countries by 2015

Economic recovery, especially in the agriculture sector, will be crucial for sustained hunger reduction, according to the report by FAO, the World Food Programme (WFP) and the International Fund for Agricultural Development (IFAD).

"Agricultural growth involving smallholders, especially women, will be most effective in reducing extreme poverty and hunger when it generates employment for the poor," the agencies said.

They said factors holding up progress include growing biofuel demand, financial speculation in food commodity markets and inefficiencies in food supply and distribution which lead to almost a third of total production being wasted.

"BIGGEST SCANDAL"

Luca Chinotti from aid agency Oxfam said lack of political action to tackle high food prices, gender inequality, land grabs and climate change risked reversing past gains in the fight against hunger.

"The fact that ... more than the population of the U.S., Europe and Canada are hungry in a world which produces enough for everyone to eat is the biggest scandal of our time," he said.

He urged governments to use a food summit next week to boost efforts to create a more sustainable food system. He suggested building up food reserves as a buffer to high prices and introducing protection programmes for those most at risk of hunger.

The Committee on World Food Security, an intergovernmental body, meets in Rome next week around World Food Day on October 16, when a ministerial meeting will discuss high food prices.

FAO, WFP and IFAD define undernourishment, or hunger, in the State of Food Insecurity in the World 2012 (SOFI) report as "food intake that is insufficient to meet dietary energy requirements continuously".

The vast majority of people suffering hunger, 852 million, live in developing countries, where the prevalence of undernourishment is estimated at 14.9 percent, the report found.

In the past two decades hunger has fallen by nearly 30 percent in Asia and the Pacific, due to socio-economic progress. Africa was the only region where the number of hungry grew over the period, to 239 million in 2010-12 from 175 million in 1990-92.

The new figures followed adjustments to population size and human height estimates. They also took into account a more detailed assessment of food availability and the amount of food wasted along the supply chain.

Are We Halfway Through Our Lost Decade?

Housing crises tend to create debt crises. And debt crises are generally far more damaging than recessions caused by bloated asset values.

I took a quick trip through FRED and Wikipedia only to be shocked at what I found.

We?re Broke, But It Sure is Cheap

Allow me to introduce you to this chart, the percentage of disposable income used to service the debt of an American household:

You?ll notice that consumers seem to be doing very well when it comes to paying their debts. We are very capable of making our monthly obligations. This is why the default rate on credit cards and auto loans is now at a multi-year low. In fact, credit card delinquencies are coming in a sloth-like pace we haven?t seen since 2001, while only 1/300 people are late on their car payments. Impressive, huh?

Most impressively, the debt service costs of the average American continue to drop while the amount of debt consumers finance has only gone up. Observe the change in this chart, a chart of the total amount of household debt relative to disposable income.

Notice that in 1980 Americans had debt equal to roughly 70% of their disposable income and debt service payments equal to 11% of their income. In 2012, we spend 11% of our disposable income to finance debt worth as much as 110% of our disposable income. Basically, $11 of debt demands as much from the American consumer budget as $7 of debt did in 1980, adjusting for changes in income.

Are the Boom Years Coming Back?

Much has been made of a falling debt service ratio. Economists believe that a falling ratio will allow for economic expansion in that borrowers are capable of carrying more debt now than they were before the collapse.

I think this is half true. I think consumers are in a position where they can afford to borrow to spend. That?s good, I suppose, from the perspective of economic growth.

However, it doesn?t address a critical problem ? where will consumers find the money to borrow and spend? That?s the real issue.

I want to introduce you to another chart of mortgage equity extraction, or the amount of money that households pulled out of home equity with financed dollars. Here?s a chart:

Not pretty. As we know, real estate fueled much of the consumption boom from 2002-2006. In fact, it is believed that 75% of all GDP growth during that period was financed by home equity. Basically, without the real estate boom, the economy would have grown at one-fourth the pace it did from 2002-2006. It would not have grown. It would have just stagnated, kind of like the economy is stagnating right now.

This is an important realization. It reminds us that the American economy will go nowhere without housing. Housing is a major source of financial leverage for American balance sheets. Take a look at just how much we inflated our ?incomes? with home equity during the boom years:

This is why I think we?re still only halfway through our lost decade. While homeowners are deleveraging, building in room in their budgets for debt, they will not be capable of borrowing for major purchases. Homeowners will not be capable of buying homes, or extracting home equity. Borrowers are capable of financing TVs, cars, or washing machines, but these are relatively unimportant when we talk about the grand scheme of things.

We still have a long way to go. Yes, interest rates are low. And yes, we are spending significantly less on debt than we have in years gone by. But we are not in a position where we can add significantly more to our personal balance sheets.

A credit card here and there and a car loan (secured!) just might fit, but a home equity loan ? the source of most American liquidity ? is still out of the picture.

Iran says it blocks cyberattack on oil platforms

TEHRAN, Iran (AP) ? Iran says it has successfully blocked a cyberattack on the computer network of its offshore drilling platforms, a semiofficial news agency reported Monday.

The report by ISNA quoted Mohammad Reza Golshani, IT head of Iran's state offshore oil company, as blaming Israel for having planned the attack.

Iran periodically reports the discovery of viruses and other malicious programs in government, nuclear, oil and industrial networks, blaming Israel and the United States. In May, Iran shut down part of its oil facilities because of another such cyberattack.

Israel has done little to deflect suspicion that it uses viruses against Iran.

In this case, Golshani said, the attack occurred over the past two weeks, was routed through China, and affected only the communications systems of the network. He said the main network was safe since it was isolated from the Internet, and was back to normal operations. Iran announced that it had temporarily disconnected its oil ministry and its main crude export terminal from the Internet after the May attack.

Iran earns up to 80 percent of its foreign revenue from the export of crude.

Iran is odds with the West over its nuclear program. The West suspects the program is aimed at developing weapons. Tehran denies the charge, saying its nuclear program is geared toward peaceful purposes like power generation and cancer treatment.

A computer worm known as Stuxnet briefly brought Iran's uranium enrichment activity to a halt in 2010.

Starting from Scratch: Using gaming to teach social justice - Learn NC

Dr. George Noblit

The School of Education at UNC is dedicated to preparing educational leaders who are committed to values of equity and excellence. George Noblit, who teaches Social Justice in Education, believes that gaming is a tool that can be used to help students engage these issues.

The Social Justice in Education course examines how education can help create more fair and just societies, ultimately contributing to high-performing educational systems internationally. Students explore multiple perspectives on social justice; examine efforts at local, state, national, and global levels; and learn to articulate efforts in classrooms and schools with wider community initiatives. The course offers a thorough examination of the role of social justice in education. As Noblit explains, ?Reducing inequalities requires working across sectors of life, and thus technology is now playing a major role in fostering access to knowledge and its interpretation.?

Students in the course develop knowledge of educative technologies as they work on social justice issues with the expectation that they will be able to use this knowledge to promote learning.

A game, you say?

According to Noblit, ?Educational gaming involves both mastery learning and constructivist learning. Students will be asked to use a theory of how social justice-related knowledge, perspectives, dispositions, competencies and/or actions develop. These theories will become the basis of educational games that teams of students create.? Students will also develop games to teach specific content in P-12 curricula using Common Core Standards for use with future students.

The platform for game design is Scratch, a programming language that makes it easy to create interactive stories, animations, games, music, and art. Scratch is a product of the Lifelong Kindergarten Group at the MIT Media Lab and receives financial support from the National Science Foundation, Microsoft, Intel Foundation, MacArthur Foundation, Google, Iomega and MIT Media Lab research consortia.

Why use Scratch?
Like Dr. Noblit, you can use Scratch to enhance learning in your classroom. Here are some key features that make it ideal for educational use:

  1. The Scratch platform does not require extensive programming knowledge, so teachers do not have to worry about a steep learning curve. Scratch users include both elementary and doctoral students along with many students who fall in between.
  2. Students who create games to teach content are more likely to retain the content themselves.
  3. Teachers and students can connect educational content from internet sources by inserting links into games they create.
  4. Over 2.8 million Scratch projects have been created to date, so users can browse through other projects to get ideas that promote learning. Design tutorials are also available to get new users started.
  5. Scratch is free and available to the public. Users can download the platform (on both PC and Mac operating systems) at scratch.mit.edu.

The Social Justice in Education course will culminate in a gaming evening where the games are played by others and assessed on the effectiveness of the game in teaching the content. Also, LEARN NC staff will review the games for possible inclusion as resources for parent, student, and teacher use.

Researcher bio:

Dr. George W. Noblit is the Joseph R. Neikirk Distinguished Professor of Sociology of Education. Since 1995 Dr. Noblit has been the series editor for Understanding Social Justice, Education and Policy (Hampton Press). He studies the various ways knowledge is constructed and how the competition over which knowledge counts constructs powers and difference. Through a study of school desegregation, he began a program of research on the social construction of race, using ethnographic research to study schools and other educational scenes. Dr. Noblit is intrigued with how knowledge?often taken as good in its own right?is implicated in creating the very problems it is asked to solve. He is coeditor of Late to Class: Social Class and Schooling in the New Economy (SUNY Press).

A full biography can be found on the UNC School of Education website.

Depending on your condition associated with house, employment position and earnings, it is possible to be eligible for a a loan up to $1500, however some loan providers may loan no more than $500. You'll have a possiblity to observe how much you be eligible for before accepting virtually any mortgage loan contract.

There is an important legal distinction from a present along with a loan. A very generous relative or perhaps pal could give you $5000 regarding car repairs, as an example. In the event that there's no hope associated with payment, the money can be viewed as a present. The actual giver could not file suit regarding repayment later inside a city suit. However, if the borrowed funds provider designates the cash just like a loan as well as the consumer pays back a buck, the amount of money can be viewed a real bank loan as well as the loan company can need payment anytime. Little statements courts invest much of time identifying whether the financial transaction which includes cash would have been a present or loan. Because of this documents is essential when making personal financial loans in order to pals or family members.

The needs for getting a loan are pretty straight forward. If you're employed, having a monthly earnings regarding $800 or higher, this will let you bank account, you fulfill the basic requirements. A number of loan providers within our network may have additional needs.

Cash lending products tend to be unprotected financial products eliminated upon your next salary. Because they're short-term financial products, they may be little; various from $100 to $1500 as well as repayment arrives in your next payday. They might be very helpful for conquering a quick financial urgent situation, but really should not be regarded as the long-term fiscal option.

Professional loan providers basically 'sell' cash, consequently borrowers must be aware simply how much financing really 'costs' in relation to actual money.

Japan hopes China friction won't hurt finance ties

TOKYO (AP) ? Japan is hoping the recent flare-up in friction with China will not damage the two Asian economic powers' cooperation in international finance, a finance ministry official said Wednesday.

The relationship with Beijing is too important to be derailed by recent antagonisms over disputed islands in the East China Sea, said Takehiko Nakao, a vice minister for finance

Violent anti-Japanese protests erupted in China recently in one of the worst flare-ups over conflicting claims to the islands called Senkaku in Japan and Diaoyu in China. Though Chinese authorities have quelled the demonstrations, the two sides have continued to trade angry accusations. A Wall Street Journal report said representatives of several major Chinese state-run banks were cancelling plans to attend the annual meetings of the International Monetary Fund and World Bank in Tokyo next week.

"It's really disappointing. I was really sorry to hear that," said Nakao. But he said Japan has had no news of any cancellations by Chinese government officials. China's government and business offices are closed this week for a national holiday.

Nakao said he hoped the problems would not spill over into the two country's financial relationship, which has progressed toward boosting use of the Chinese and Japanese currencies instead of the U.S. dollar for international trade. The two sides also have agreed on mutual purchases of government bonds by each side.

"There has been trust and good cooperative relations ... and my strong belief is that we should continue to do this," he said.

Along with the IMF and World Bank meetings, finance ministers of the "Group of Seven" major industrial economies also will meet in Tokyo, Nakao said.

China's slowing growth is bound to be a focus of the Tokyo meetings, along with the U.S. predicament over its "fiscal cliff" ? the risk of deep spending cuts and tax increases if the U.S. Congress fails to reach a budget deal by the end of the year.

Nakao, who recently visited China, said he believed there was room for Beijing to do more to stimulate the economy, but that Chinese officials were wary of reigniting inflation and also hindered by uncertainty over upcoming changes in the top Communist Party leadership.

Japan's own domestic political upsets, on top of its territorial tussles with both China and South Korea, are unwelcome distractions at a time when Tokyo is striving to help stabilize the global financial system and get its economic house in order.

Finance ministers meeting in Tokyo next week will be mainly focusing on broad issues such as the European debt crisis, reforms of the IMF and helping along the struggling global recovery.

While the dollar should remain the "center" for international finance, Nakao said Tokyo favors wider use of local currencies to help reduce risks and prevent problems at times of crisis when the dollar ? which tends to be used as a safe haven currency ? is in short supply.

Though it will host next week's meetings, Japan has little influence over their agenda. Its ability to shape policy also may be hampered by frequent changes in leadership. This week, Prime Minister Yoshihiko Noda named a new finance minister, Koriki Jojima, in his third cabinet reshuffle since he took office 13 months ago.

Great Barrier Reef has lost half of its coral in the last 27 years

ScienceDaily (Oct. 2, 2012) ? The Great Barrier Reef has lost half its coral cover in the last 27 years. The loss was due to storm damage (48%), crown of thorns starfish (42%), and bleaching (10%), according to a new study published in the Proceedings of the National Academy of Sciences by researchers from the Australian Institute of Marine Science (AIMS) in Townsville and the University of Wollongong.

"We can't stop the storms but, perhaps we can stop the starfish. If we can, then the Reef will have more opportunity to adapt to the challenges of rising sea temperatures and ocean acidification," says John Gunn, CEO of AIMS.

"This finding is based on the most comprehensive reef monitoring program in the world. The program started broadscale surveillance of more than 100 reefs in 1985 and from 1993 it has incorporated more detailed annual surveys of 47 reefs," says one of the program's original creators, Dr Peter Doherty, Research Fellow at AIMS.

"Our researchers have spent more than 2,700 days at sea and we've invested in the order of $50 million in this monitoring program," he says.

"The study shows the Reef has lost more than half its coral cover in 27 years. If the trend continued coral cover could halve again by 2022. Interestingly, the pattern of decline varies among regions. In the northern Great Barrier Reef coral cover has remained relatively stable, whereas in the southern regions we see the most dramatic loss of coral, particularly over the last decade when storms have devastated many reefs. " says Peter Doherty.

The study clearly shows that three factors are overwhelmingly responsible for this loss of coral cover. Intense tropical cyclones have caused massive damage, primarily to reefs in the central and southern parts of the Reef, while population explosions of the coral-consuming Crown-of-thorns starfish have affected coral populations along the length of the Reef. Two severe coral bleaching events have also had major detrimental impacts in northern and central parts of the GBR.

"Our data show that the reefs can regain their coral cover after such disturbances, but recovery takes 10-20 years. At present, the intervals between the disturbances are generally too short for full recovery and that's causing the long-term losses," says Dr Hugh Sweatman, one of the study's authors.

"We can't stop the storms, and ocean warming (the primary cause of coral bleaching) is one of the critical impacts of the global climate change," says AIMS CEO, John Gunn. "However, we can act to reduce the impact of crown of thorns," he says. "The study shows that in the absence of crown of thorns, coral cover would increase at 0.89% per year, so even with losses due to cyclones and bleaching there should be slow recovery.

"We at AIMS will be redoubling our efforts to understand the life cycle of crown of thorns so we can better predict and reduce the periodic population explosions of crown of thorns. It's already clear that one important factor is water quality, and we plan to explore options for more direct intervention on this native pest."

The analysis presented in the paper was conducted with partial support from the Australian Government's National Environmental Research Program.

NJ schools report 12K bullying instances last year

New Jersey education officials now have some handle on just how much bullying happens in the state's public schools. Data made public Tuesday show there were 12,024 instances of harassment, intimidation and bullying reported in the 2011-12 school year ? the first year the state's tough new anti-bullying law was in effect.

New Jersey used a new definition of the behaviors, so there are no previous data for comparison. The numbers of incidents reported Tuesday vary widely by district and may reflect how diligent each school is at reporting, rather than how much bullying there is.

Bullying in school, once written off as just something kids have to deal with, has evolved into a serious issue. New Jersey was among a wave of states that passed anti-bullying laws a decade ago after the school shooting at Columbine High School in Colorado.

In 2012, it's far more widely seen as a real problem. On Tuesday, a television anchorwoman in La Crosse, Wis., went on air with a four-minute segment criticizing a man who emailed her about her weight. Jennifer Livingston called the man a bully and told young viewers not to let people like him affect them.

New Jersey's law got an overhaul, which advocates said made it the nation's toughest, in a law passed in 2010 and signed by Gov. Chris Christie in 2011. Though the bill was already in the works, attention given to the 2010 suicide of Rutgers student Tyler Clementi, whose freshman-year roommate used a webcam to watch him kissing another man, resulted in quick passage of the state's new law.

Now, schools are required to have anti-bullying programs and coordinators while those measures previously had been merely recommended.

And schools are required to report instances of bullying to the state.

In the state's report tabulating those reports for the first time, Woodbridge, a district with more than 13,000 students, had the most reported incidents, with 177. Newark, the state's largest school district with more than 39,000 pupils last year, had 105 reported incidents.

In Camden's school district, there were 35 reported incidents. But at D.U.E. Season, a small charter school in Camden ? and not considered part of the school district ? there were 16.

Some mid-size districts reported no bullying incidents.

The state also says that there were fewer assaults, fights, criminal threats, robbery, extortion and vandalism last year, compared with the previous school year.

While relatively small numbers, there were more cases of students caught with guns and drugs at school.

The story behind the stingray photobomb

(Kendall Harlan)

An image of three seemingly terrified women being "photobombed" by a man with a giant stingray went viral last week after it was posted online, catching the women in it by surprise.

"Our phones just started going off," Kendall Harlan, one of the women, told Yahoo News. "Friends were texting us [things] like, 'Did you know you were just on "Good Morning America"?'"

The photo?showing a tour guide in the water behind the women lift the stingray onto their backs just as the photo was taken?was snapped during a 2008 spring break trip to Stingray City, a popular tourist destination in the Cayman Islands, when the trio (Harlan, Sarah Bourland and Natalie Zaysoff) were sophomores at Texas Christian University. They uploaded the photo to Facebook, where it was shared by friends. But it did not achieve viral status until last week, when a former classmate posted it on Reddit.com.

Harlan, now a 24-year-old advertising executive in Austin, Texas, says a picture taken right before the now-famous photobomb shows the co-eds smiling while posing in the water with a stingray. The tour guide threw another stingray up behind them, and the rest is Internet history.

Harlan added that she did not know the two older women in the photo who appear to be laughing as the three recoil in terror.

Someone Posts A Picture Deemed Insulting on Internet So Muslims in Bangladesh Protest Religious Intolerance By Burning Down Four Buddhist Temples and 15 Homes of?Buddhists

We have yet another rampage by Muslims protesting religious intolerance. Muslims claimed that a Buddhist man posted a picture deemed insulting to Islam. They responded by promptly burning down at least four Buddhist temples and then burning down the homes of at least 15 Buddhist families. That should show people not to be religiously intolerant.

The hundreds of Muslims went on a rampage at the Cox?s Bazar in Bangladesh where the two religions have lived in harmony . . . until some alleged Buddhist posted one picture on the Internet.

I just wondered what everyone was like in real life! You dont have to put anything about yourself if your dont wish too :3

My name is Amy, I am 14 years old. Female, just if you weren?t clever enough to work out by my name. My hair reaches my shoulders and is dyed red, I have teal iris's and sadly wear a pair of square framed black glasses. I'm small and thinish with tanned skin, often wearing black, but I wouldn?t class myself as emo or anything. I'm just a individual.

My personality is kind of split. So spilt in fact I think I have bipolar or cross boarder personality. One side of me is sweet, well mannered, manically giddy and pleasantly caring. The other side is cold, smug, sarcastic, and very angry. Sometimes I just flip out, sometimes becoming a little violent. Afterwards I fall into a depression. It?s kind of weird.

It hurts not knowing who you are...

I enjoy gaming! Which I guess is odd for a girl. I love Resident evil, Final Fantasy, and Zelda. Other things I enjoy are: Reading, writing, horror films, anime, manga, online comics, youtubers, (Pewdiepie<3) drawing, becoming obsessed with things, getting scared, daydreaming, and just being a reject of society.

We shall be making a family, the Slenders. Yes, that is our family name. From now on. No arguments!!!

My name is Mark, I am 15. Male. I have long hair, for a guy, and it's brown. My eyes are dirty blue or grey depending on the light. In my house I'm tall then I leave and remember I'm just part of a small family, as in little, there is 5 in my family we're about average sized. I'll wear any colour.

My friend wrote in my careers booklet, for school, "Mark is cuddly, bubbly, giggly and eccentric, friendly and always there for you." We found it funny because the teacher was just like laughing at us and random shizzle. Anyway, I'm the agony aunt in my group, any problem a hug from me and a cry on my shoulders and you feel better.
