WASHINGTON (AP) ? Keep your friends close, and your former presidents closer.

President Barack Obama is welcoming his favorite foil, former President George W. Bush, back to the White House on Thursday for the official unveiling of Bush's portrait. Given the history, the scene ought to be quite a picture.

Obama is still bad-mouthing Bush's time in office, and it's not just because of the debt and the unfinished wars Obama inherited. Obama sees Bush's economic ideas as the same as his current rival, Mitt Romney, so he lumps them together.

Which makes it a little awkward that Obama is about to preside as Bush's image and legacy are enshrined forever.

Never mind all that, say the Obama and Bush camps. This is a timeout for tradition.

The political reunion is expected to put aside any campaign rhetoric, as other gatherings among past and current presidents have, to honor nostalgia and the service of the former president and his wife, Laura.

In the heart of a re-election year, Obama will to get to rise above the fray for a day and play statesman.

He and his wife, Michelle, will host generations of Bushes for a private lunch, including former President George H.W. Bush and former first lady Barbara Bush. Family members will join them.

Then, in the ornate East Room, Obama and George W. Bush will speak as the portraits of the former president and Laura Bush are unveiled. The audience will be filled with friends and officials from Bush's two terms in office.

No one close to the current or former president expects the least sign of animus Thursday, particularly given that their transition in 2009 was handled with grace and that they have since shared moments of help and healing.

"President Bush has been around politics a long time. He's been around how presidents deal with each other for a long time," said Tony Fratto, one of his former spokesmen at the White House. "He has an understanding for separating the necessities of political rhetoric from the job itself."

Still, Bush has been holding his tongue for a long time. Obama has never run against Bush, although it was easy to forget that during the 2008 race between Obama and Sen. John McCain, when Bush's tenure was so often Obama's target.

In his inaugural address in 2009, Obama declared that "we are ready to lead once more," seen by some as a dig at Bush, who was seated over his shoulder. Even now, hardly a day goes by when Obama's team does not blame Bush for a mess.

It was just one week ago that Obama, revving up campaign donors, turned Bush into a punch line. Obama depicted presumptive Republican presidential nominee Romney as a peddler of bad economic ideas, helping the rich at the expense of the middle class. He then added: "That was tried, remember? The last guy did all this."

Now the last guy is coming back.

Only 44 men in history, and five men alive, have held the job.

It will be a rare limelight moment for Bush, who has not been back in more than two years.

Obama and Bush have a cordial and respectful relationship, but they are not close.

Both are political veterans who are able to separate political tactics from what they see as an overarching community among people who have served in the Oval Office, according to people close to them.

History has marked this moment before, with grudges put aside.

When Bill Clinton came back for his portrait unveiling, Bush lauded him for "the forward-looking spirit that Americans like in a president." This after he ran for the presidency to "restore honor and dignity" after Clinton's sex scandal.

And when Clinton welcomed back George H.W. Bush, whom he had defeated, he said to him and his wife: "Welcome home. We're glad to have you here."

"I would be surprised if there's very much tension" this time around, said Cal Jillson, a political science professor at Southern Methodist University who has long followed Bush's career.

Obama has enlisted Bush's help on earthquake relief for Haiti, and the two stood together in New York City last year in marking the 10th anniversary of the Sept. 11 attacks on America. They have also spoken at least three times at signature moments over the last three years, including the killing of Osama bin Laden.

Still, Obama's bashing of Bush's record sets a backdrop.

"This president is looking for someone to blame," Romney said while campaigning in Colorado this week. "Of course, he started off by blaming George Bush, and that worked for a while but, you know, after three and a half years that wears kind of thin."

The White House points out that Obama praises Bush sometimes, too, such as for taking on illegal immigration.

The visit is layered with political story lines.

Bush's brother Jeb is a potential vice presidential candidate to Romney. Bush's father has developed a kinship of sorts with Obama. And then there is Bush himself, who has endorsed Romney but is still viewed by many in his party as politically toxic.

More than any president in recent memory, Bush has not just intentionally faded from the public spotlight but all but disappeared from it.

Bush was last at the White House in January 2010 to help out with Haiti humanitarian relief.

Bush spokesman Freddy Ford said the former president and first lady are grateful to the Obamas and looking forward to catching up with faces from their past, including staff at the Executive Mansion.

Jenna Bush Hager, one of the George W. Bush's daughters, told "Fox & Friends" the day will be a chance to "celebrate his work, 'cause he worked pretty hard, so I think he deserves at least a painting."

As to where it will go, she said: "Probably in the very back somewhere. I'm just kidding."

Actually, the painting will hang prominently in the formal entrance hall to the White House, the Grand Foyer.

Lifestyles of over 300,000 people in eight European countries found that people who ate at least eight servings of fruits and vegetables a day had a 22 percent lower risk of death from disease than those who ate three servings days.The researchers say that factors such as cost and availability of fruit and vegetables are likely to account for differences in consumption.

This is a much more modest for an individual, but if everyone could achieve this then the population level, the impact would be large enough. 5-a-day minimum

The intensification of five servings eight servings per day could be difficult, but Crowe said, can be a guideline for public health more manageable to recommend that everyone increase their consumption of one portion per day.

Taylor continues: We still do not know exactly why you see the relationship between fruit and vegetables and heart disease. This may be something of fruit and vegetables per se, but it could be something in the lives of people who tend to eat more fruits and vegetables. It?s still work to be done by researchers to answer these questions.

Study researcher Francesca Crowe, MD, Unit of Cancer Epidemiology at the University of Oxford in England, tells WebMD via email, we must be cautious in our interpretation of these findings that participants with increased consumption of fruits and vegetables tend to be slightly more healthy. The Real Estate Personal Marketing Tools of the Trade- Agent ...

Okay, back to reality now. Think about your real estate career for a second. What ?tools? do you have at your disposal? Do you know how to use them? Most importantly, what, exactly, are you building?

These questions are critical to your success as a real estate agent. We encounter many agents whose ?tool boxes? look like a variety pack acquired over the course of a 20-year career. None of their marketing materials match each other and they don?t know how to use half of them anyway. This is a waste of money, a waste of time and a waste of energy. There is a better way.

The First Step: Education

The first thing every agent serious about branding must do is educate him or herself. Many agents make decisions regarding personal marketing based on typical Realtor? thinking and the things they see their colleagues doing. The result of that mentality can be seen in hundreds of pages of house ads in every real estate magazine distributed throughout the United States and Canada. The essential elements of any powerful personal marketing campaign are the same no matter what your market is like or who you are. What will vary is how you?re going to use them based on what you?re trying to accomplish and the market in which you work.

Quite simply, every real estate agent working today should have a full-color, high-quality personal brochure and several multiuse direct mail pieces such as the Hobbs/Herder House Flier master and Powerkard , an oversized postcard that immediately and consistently delivers your name and image to homeowners in your farm area. So those are what I call ?The Essentials? of personal marketing. Why would you want or need anything else, you ask? Well, here?s the catch. Here?s an example: On its own, a TV commercial on cable TV is not going to be the most effective usage of your marketing dollar. It will raise awareness of you in your market, but it alone will not change the way you live and do business. But if you already have a consistent direct mail campaign in place, where homeowners are receiving three pieces of mail from you each month, a TV commercial will significantly enhance your image with those consumers who are already aware of you. That?s what makes ?The Enhancers? such attractive tools in the tool box. You might not use them as frequently, but their ability to perform a specific task is remarkable and powerful.

Just as with our actual tool box, the more marketing tools you have, the more you can do and the easier it becomes to build things of value ? in this case, your name and image in your marketplace.

Step Three: Execution

Once you?ve educated yourself and obtained a full complement of personal marketing tools necessary to be successful, the final step is implementing systems that will allow your marketing to run smoothly ? regardless of how busy you get ? and allow you to focus on serving your clients.

This requires a systematic approach to every possible aspect of your career except for your ?dollar productive? work such as going on listing presentations. Derived from the words ?foreign exchange,? Forex is the largest financial market in the world. A highly liquid, voluminous market based on no specific fixed exchange, the forex is traded through financial institutions, dealers, brokers, banks and, most recently, private individuals. An up-and-coming endeavor for the smaller, personal investor, the forex market has only recently become accessible to such traders. In the past, large, required deposits counted out the small investors. But with the advent of internet trading and growing competition within the market, this type of trading is easily accessible for the average investor. Innovations in technology (ie: Internet, 24-hour trading and a global economy) have made it easier than ever to monitor the market and trade when necessary, but without proper forex training and education, private investors run a dangerous road.

Forex trading indicators abound, aiding investors in their search for optimum trading times and investing opportunities. Countless amounts of time and energy can be spent studying the latest indicators for keys to success in the market.

The average true range indicator measures the volatility of a given forex trading market, where high values indicate that currency trading prices are changing a large amount during the day. Trading bands, such as Bollinger Bands, are among the most popular technical indicators on the market today. In essence, they are lines drawn at certain intervals around a central moving average. They vary in distance from the moving average, once again based on volatility. Another widely used indicator, the Commodity Channel Index, determines how far the current price has been from the average price. These traders state that although indicators are the buzz word today new traders should keep in mind that if there was a way to figure out the market, there would be no market. These traders also say that the ultimate trading indicator, is simply put: price. All other indicators should follow. Success can only be obtained on the forex through proper training, practice, implementation of knowledge learned and repeating those steps consistently, he concluded.

With correct training and implementation of correct indicators, trading the forex can be ideal for private investors on many levels. First, it is easy to exchange most currencies based on the enormity of the market. Second, volatility of the market leads to large profits in a very short time. While this is a dangerous investment without a thorough understanding of the market, proper forex training will put any investor in the profit margin. Third, 24-hour-a-day trading, five days a week allows constant access to the forex via telephone, Internet or a broker.

Tenant - Retail Real Estate Law Ruminations

Ruminations has been discussing what should happen when a tenant?s exclusive use right is breached. One of the remedies suggested in prior postings, as well in reader?s comments, is the tenant?s right to terminate the lease. That?s a remedy brought up in other contexts as well. So, it seems appropriate to discuss the ?lease termination remedy? in a somewhat general way, not just when it come to exclusive use rights.

Many leases give a tenant the right to terminate the lease if some things go wrong, not just when anything goes wrong, but certainly when a listed condition occurs. To Ruminations, there are two categories of such things that can go wrong ? those that are the result of a breach by the landlord, and those that are not the result of a breach by the landlord.

When a tenant gets the right to terminate a lease it may be ?off the hook? when it comes to lease obligations (think, paying rent), but is also loses use of the premises. In some cases that?s good; in others, that?s not so good. More about that below.

Let?s talk about when a tenant uses lease termination as a remedy for its landlord?s breach. That may look like the mirror image of the remedy the landlord gets when its tenant breaches the lease ? eviction or lease termination ? but, not if it is the tenant?s sole remedy. After all, a landlord can evict its tenant and still chase its tenant for damages to make itself ?whole.? If the tenant is only afforded lease termination as its ?sole? remedy, it may not have been made ?whole.? So, that?s rule one for tenants who are negotiating a termination remedy when the landlord has breached the lease ? you need to reserve the right to avail yourself of your other lease and legal remedies, such as to pursue damages.

Now is time for an example. Please keep in mind that the following somewhat common provision in small leases, while very often the result of unequal bargaining power, shockingly it often results from ignorance. Picture a lease that says if the landlord fails to require later-in-time tenants to abide by your exclusive use rights, you, the tenant, as your sole remedy, may terminate the lease. So, you have the exclusive right to sell pizza in your 1,200 square foot store. Along comes a prospective national chain restaurant that want to sell pizza as a featured menu group. Your landlord thinks: ?I get a big, secure tenant in that 7,500 square foot vacant space that has been sucking wind and my little pizza shop terminates its lease ? ?not a bad trade.?? So, your business drops 30% and, as your sole remedy, you terminate your lease. Feels great, doesn?t it? You?re saying: ?look how smart I was, I got the exclusive right to sell pizza.? Yes, you are out of your lease, but you are also out of business. [By the way, a self-employed individual who loses a job because the business folded doesn?t collect unemployment insurance.]

There is a small glimmer of hope for the tenant who may be willing to risk the money. As we have ruminated in earlier postings, perhaps the landlord, in making the choice to deliberately breach its agreement that you will be the only seller of pizza at the shopping center, has also breached another lease provision. Which one, you ask? Try the covenant of good faith and fair dealing implied in every contract (and that includes leases). We?ve not yet seen that case, but we can?t figure out why not, except for the possibility that it costs a lot to prosecute such a claim as a case of first impression.

Now, when can the sole remedy of terminating its lease make sense to a tenant (or even a landlord)? We think it makes sense when the bargain reached between the parties can?t be realized because of an uncontrollable event. Give me an example, you say. Let?s say the tenant leased its space relying, in a measurable way, on the existing, unimpaired four-way access and exit from the property. Then, governmental authorities make the road into a divided highway and it isn?t very convenient to get to the shopping center any longer. Neither the landlord nor the tenant did anything wrong. Had the road been a divided highway at the outset, the tenant wouldn?t have gone there in the first place. [Don?t argue the facts, this is a reasonable hypothetical example.] Will the landlord be hurt if its tenant terminates the lease? Yes, but at least it still has an asset. The value of the asset may have dropped by reason of the impaired access, but that would have happened with or without the departing tenant in place. Plain and simple, in our hypothetical example the rent just became too high. The landlord can try to entice the tenant to stay by offering rent at the new, lower market rate, and the tenant might decide that it is worth its while to stay rather than to move. Basically, it would be looking at the space with fresh eyes, but it would be influenced by whether the good will it has garnered at that location tips the scales in favor of staying at the lower rent..

You can add you own examples, including the panoply of ?contingencies? or ?conditions precedent? we commonly see in leases. Most parties accept that if a certain list of conditions aren?t satisfied, the tenant can terminate the lease before it takes occupancy ? things like failure to get approvals, failure to get a liquor license, lack of an SNDA, etc. Even landlords have such items, the failure of which to obtain would allow them to terminate a lease, such as failure to get a lender?s approval for the lease, inability to get an exclusive use waiver from another tenant or inability to get land use approval.

The examples in the paragraph above are pretty non-controversial, although often subject to intense bargaining. As to conditions that might come up after the lease has ?started,? some are more controversial. In every case, the question is: ?who should take the risk? of an event that wasn?t caused by either party ? one for which no party would be expected to pay damages to the other. Some examples ? a taking by eminent domain (even just of significant parking), fire (beyond a certain time threshold to restore the premises or the balance of the buildings), environmental stigma, loss of a specified number of key tenants or development of a major, adjacent competing shopping center. This isn?t a one way street. Landlords may want (need) the right to terminate a lease if really bad things happen warranting redevelopment of the shopping center for non-retail use. Yes, perhaps if occupancy drops below a certain amount, the landlord should have the right to terminate a lease (with or without payment) if terminates all other leases and agrees not to redevelop as a retail property for (say) five years.

Can we sum this up? We?ll try. When one party breaches its lease obligations, the other party should be entitled to be made whole. Depending on how fundamental the breach is to the usefulness of remaining at the property, a tenant may also deserve the right to cut its losses and get out of its lease. That should be a choice, not a required or sole remedy. That?s just like what a landlord typically gets. A landlord can choose to evict or not and still retain the right to be compensated by its tenant for damages.

If nobody is at fault, but the bargained for deal really, really doesn?t work because of an uncontrollable event, then the damaged party should be able to cut its losses. Usually that translates to allowing the tenant to choose between going and staying because the landlord still has the property and its diminished value was a feature of the property, not a feature of the lease.

Of course, just like in tax matters where everything is deductible until audit, in leases everything is subject to bargaining and affected by the relative bargaining powers of the parties at the time a lease is signed.

AWOL Muslim soldier guilty in Fort Hood bomb plot

WACO, Texas (AP) ? A federal jury on Thursday convicted a Muslim soldier on six charges in connection with a failed plot to blow up a Texas restaurant full of Fort Hood troops, his religious mission to get "justice" for the people of Iraq and Afghanistan.

Jurors in U.S. District Court in Waco deliberated a little more than an hour before finding Pfc. Naser Jason Abdo guilty of attempting to use a weapon of mass destruction, attempted murder of U.S. officers or employees, and four counts of possessing a weapon in furtherance of a federal crime of violence.

Abdo, 22, did not stand with his attorneys when jurors and the judge entered the room, and he showed no emotion when each of the six guilty verdicts was read by the court clerk. Abdo, who's been accused of spitting blood on authorities escorting him and a jailer, wore a mask covering his nose and mouth throughout the trial.

He faces up to life in prison. U.S. District Judge Walter Smith is set to sentence Abdo in July.

Prosecutors said Abdo had already started making a bomb when he was detained at a Killeen motel last July after going AWOL from Fort Campbell, Ky. Authorities also found numerous bomb-making components, a loaded gun, 143 rounds of ammunition, a stun gun and other items in his backpack and motel room.

In a recorded police interview, Abdo said he was planning to pull off an attack in the Fort Hood area "because I don't appreciate what my unit did in Afghanistan."

He told authorities he planned to put the bomb in a busy restaurant filled with soldiers, wait outside and shoot anyone who survived ? and become a martyr after police killed him. Abdo told an investigator that he didn't plan an attack inside Fort Hood because he didn't believe he would be able to get through security at the gates, according to testimony.

During the four-day trial, a recorded jail conversation was played for jurors in which Abdo told his mother his religion inspired his actions and he was seeking "justice" for the people of Iraq and Afghanistan.

"Their suffering is my suffering," he said.

Abdo's lead attorney, Zach Boyd, told jurors during closing arguments that Abdo should be acquitted because his plan never progressed beyond preparation.

Killeen police began investigating Abdo on July 26 after a gun store employee reported a young man bought 6 pounds of smokeless gunpowder, shotgun ammunition and a magazine for a semiautomatic pistol, while behaving in an odd manner and seeming to know little about his purchases.

Officers also learned that Abdo bought a U.S. Army uniform and a "Smith" name patch from another store, and jurors saw surveillance footage showing him leaving the store wearing the uniform he just bought. He was detained July 27 after police tracked him to the motel in Killeen, about 150 miles southwest of Dallas.

"A disaster was averted because somebody picked up the phone and made a call," prosecutor Mark Frazier told The Associated Press after the trial, when the judge's gag order was lifted. "The people who work in businesses like this are vigilant ... and risked being embarrassed if their suspicions turned out to be nothing, but that's what we want people to do."

Abdo went AWOL from the Kentucky Army post over the Fourth of July weekend, about two months after he was charged with possessing child pornography, which put his conscientious objector status on hold.

Abdo then went to Nashville, bought a gun from an online seller and kept traveling until he ended up in his Dallas-area hometown. He paid cash for food, motel rooms and bus and cab fare and used his roommate's ID card. When his Dallas friends didn't help him, he wanted to go to South Texas but chose Killeen because he remembered news reports of the 2009 Fort Hood shooting rampage in which a Muslim soldier is charged, according to testimony.

Maj. Nidal Hasan faces the death penalty in the Fort Hood shootings if convicted at his trial, which starts in August.

Abdo became a Muslim when he was 17. He enlisted in the military in 2009, thinking that the service wouldn't conflict with his religious beliefs. But according to his essay that was part of his conscientious objector status application, Abdo reconsidered as he explored Islam further.

In that essay, which he sent to the AP in 2010, Abdo said acts like the Fort Hood shootings "run counter to what I believe in as a Muslim."
